Terms and Conditions


Amen Church Seating Terms and Conditions

1. Product Price Quotes:
Quoted prices for church chairs, sanctuary seating, stack seating, or any other church furniture are valid for 3 days condition to availability and unless otherwise specified in the quote. All quotes must be in writing. Amen Church Seating reserves the right to cancel, withdraw, revoke, rescind, annul, or void any quote or quoted price at any time. Printed prices, such as in price lists and catalogs (excluding specific quotes), are subject to change without prior notice.

2. Placing Orders/Verifying Quotes:
To place an order for church chairs, sanctuary seating, or any other church furniture, the following must accompany your order:

  1. Payment of the deposit as outlined in the quote. By submitting the deposit payment, the buyer agrees that the order is formally finalized and legally binding. The payment itself serves as confirmation that the buyer accepts the quote and all Terms and Conditions specified.
    The quote is valid only under the terms and conditions specified. Any changes in contact or shipping details, model, quantity, finish, fabric, or options must be reflected in a revised quote, which will replace any previous quotes or Purchase Orders. Any terms in your order that do not match the terms in the quote and these Terms and Conditions will not be part of the contract.
    Orders are non-cancelable and non-negotiable once accepted. All credit orders are subject to credit approval. Amen Church Seating’s quote and Terms and Conditions override any conflicting terms in a Purchase Order. This contract can only be modified or rescinded in writing and signed by authorized agents of both parties.
     

3. Order Acknowledgements:
Once an order is accepted, Amen Church Seating will send an order acknowledgment with an estimated ship date. It is the customer's responsibility to confirm and review all order specifications and ship dates.

4. Order Terms, Deposits, Exemptions:
Standard payment terms for church seating orders are 50% prepayment with the remaining 50% due before production. Prepayment requirements may be higher depending on the credit review. Special payment terms must be pre-approved and indicated in the quote.
The buyer is responsible for ensuring all applicable sales and use taxes are paid. If Amen Church Seating is required to pay sales tax on behalf of the buyer, the buyer must reimburse Amen Church Seating. Sales tax exemption requests must be accompanied by the appropriate documentation, such as a "Resale Certificate" or "Sales and Use Tax Exemption" form.
All deposit checks must include the order number, phone number from the quote in the memo portion to ensure proper credit to your account. Failure to do so may delay shipment. Re-payment for NSF (non-sufficient funds) will require a certified or cashier’s check. Any NSF order will not be eligible for C.O.D. and must be paid in full before shipment.

5. Change Orders:
Any changes (Change Orders) must be submitted in writing and are subject to Amen Church Seating's approval. A $175 administration fee will be charged for any changes to model numbers, fabric, or options. If the number of chairs is reduced or the fabric changed, the customer is still responsible for the original fabric purchase. Once an order enters production, no further changes can be made.

6. Cancellation Policy:
As our church chairs and sanctuary seating are custom-built to meet the customer’s specifications regarding fabric, color, and options, cancellations can be difficult. If a customer cancels their order, they are fully responsible for the entire order amount, including freight expenses. If the chairs are already built or in stock, a 20% restocking fee will be applied, along with return freight expenses.

7. Past Due Payments:
Balances not paid within the agreed terms will incur a 2% monthly finance charge (24% APR). If an outside agency or attorney is required to collect overdue payments, the customer will be responsible for all related fees. Until the balance is paid in full, all church seating products remain the property of Amen Church Seating and can be reclaimed. Failure to pay invalidates any warranties on the products.

8. Payment Plan:
Any payment plan authorized by Amen Church Seating must be approved and signed by both parties. When the deposit is given, it is the customer's responsibility to follow through with the payment plan. Any non-fulfillment of the payment plan, including late payments or other issues, will result in the full balance becoming immediately due. Failure to pay the balance in full may result in the matter being passed to a collection agency. The customer will be responsible for legal expenses, collection expenses, and any late charges or fees associated with collection.
At the moment of non-fulfillment of the payment plan, the customer agrees to allow Amen Church Seating to reclaim the chairs, and the customer will assume all costs related to restocking fees (20%), shipping, handling, and depreciation for the time used. The customer will also be responsible for storage fees if the chairs are returned or stored. Payment plans are binding between the church and Amen Church Seating.

9. Reorders:
If the fabric for a previous order is discontinued, Amen Church Seating will attempt to provide alternative fabric options at similar pricing. When reordering, new fabrics or finishes may not perfectly match the original purchase due to natural wear and fading over time. Any differences will be the responsibility of the buyer.

10. Special Orders:
Amen Church Seating reviews all requests for modifications or special features to current products. If accepted, the customer will be notified of applicable engineering, tooling, or setup costs.

11. Shipping & Offloading:
Church chairs are typically shipped wrapped and stacked in sets of 10–12 chairs. Customers are responsible for ensuring adequate manpower and equipment, such as hand trucks, to offload and move the chairs into their facility.

12. First Articles:
A sample chair is not considered a first article, and it does not imply any warranty or guarantee. Amen Church Seating continually works to improve the quality of its products and reserves the right to make design changes. If a customer requests a first article for review, it will be provided at a cost of $100 per custom fabric order (COM). Custom orders are accepted only after the customer approves a one-yard fabric sample.

13. Lead-Times & Delivery Dates:
Lead times for church chairs and sanctuary seating are estimates and are dependent on when an order is placed relative to the quoted lead-time. Amen Church Seating is not responsible for any consequences resulting from delayed deliveries and will not be held liable for any costs incurred from such delays.

14. Priority/Rush Orders:
Orders requiring expedited delivery are considered priority/rush. Priority orders incur a $250 minimum charge or a $1.75 per chair fee, whichever is greater. Amen Church Seating will attempt to meet priority deadlines but cannot guarantee them.

15. Freight Carriers, Damage Claims:
All domestic orders are FOB Amen Church Seating’s factory. Claims for damage due to shipping must be indicated on the “Bill of Lading” and reported to Amen Church Seating within 10 working days. Amen Church Seating is not responsible for shipping issues caused by third-party carriers. International customers must manage shipping costs and arrangements.

16. Customer Delayed Shipping:
If customers are not ready to accept their order, they are responsible for storing the chairs. Storage fees will apply after three working days if the chairs are not picked up or delivered to an alternate location.

17. Refused or Returned Shipments:
Refusal of delivery does not absolve the customer from payment. If a shipment is returned, the customer will be responsible for all associated storage and return freight fees. Final shipment will not occur until the balance is fully paid.

18. Defective Products:
Defective products must be reported within 10 working days of delivery. Damage claims must be indicated on the “Bill of Lading” and reported immediately. Most issues can be resolved within two weeks.

19. Product Warranty:
Amen Church Seating provides a warranty on all its church chairs, stack seating, sanctuary seating, and other church furniture. Details of the warranty can be found at AmenChurchSeating.com/warranty. Please note that certain components, such as upholstery, frame finishes, and seat foam, are not covered under the warranty for normal wear.

20. Warranty Limitations:
Wearable components, such as upholstery, upholstery treatments, and seat foam when soiled or used outdoors, are not covered under Amen Church Seating’s limited lifetime warranties.

21. Warranty for Chairs Outside Continental U.S.:

22. Governing Law:
This agreement shall be interpreted and governed by the laws of the state of Florida as if entered and wholly performed within the state of Florida. Any action brought to enforce this agreement shall be brought in the County of Miami-Dade, Florida.

Additional Modifications and Clarifications

1. Reclaiming Chairs and Loss Recovery:
In the event that the customer does not fulfill their payment plan or fails to pay the outstanding balance, Amen Church Seating retains the right to reclaim the chairs. The customer agrees that the reclaimed chairs will be returned to Amen Church Seating’s inventory. In such a case, the customer will be responsible for:

  • Storage Fees incurred due to the chairs being held for any period.
     
  • New Marketing Expenses necessary to re-sell the used chairs.
     
  • Depreciation for the time the chairs were used, typically resulting in a loss of value of the chairs (which may range from $15 to $35 per chair depending on their condition and the amount of time they were in use).
     

2. Injury Liability Clarification:
Amen Church Seating is not liable for any injury or damage resulting from the use of the church seating after delivery and installation. By accepting the chairs, the customer agrees to maintain the seating in a safe condition. The customer is solely responsible for ensuring that chairs are used in compliance with all safety protocols and regulations. Amen Church Seating will not be held liable for injuries that may occur from the use of the seating or from accidents arising during unloading, installation, or use.
